As of right now, possession of psilocybin mushrooms in Alabama results in Class D felony charges, with repercussions including at least 1 year and 1 day of incarceration and up to $7,500 in fines. Being that psilocybin and other psychedelics like LSD and MDMA are considered Schedule 1 drugs, consequences for distribution fall under a Class B felony, with the possibility of up to 20 years of imprisonment. 

Substances that fall under Schedule 1 classifications are considered to have no medical use and display potential for abuse. Of course, plenty of scientific studies have since proven the efficacy of psychedelics for treatment of a variety of different disorders, but federal legislation has unfortunately not yet wavered.

Though we should note that in July of this year, President Joe Biden announced that he anticipates MDMA and psilocybin to be approved by regulators within the next two years. Meaning that psychedelics may be approved for therapeutic use on a federal level before being decriminalized or legalized by Alabama state officials. 

As is also the case in most states, psilocybin spores are legal to possess in Alabama. However, the spores cannot be legally grown into maturity. When psilocin, the active metabolite of psilocybin mushrooms, starts to become present in the fruiting body, possession charges can be enacted.

The Psychedelic Culture in Alabama

Though psychedelics are not yet legal for recreational and medical use in Alabama, the state’s Oklevueha Native American Church of Inner Light has received legal exemption for its members to partake in peyote and psilocybin ceremonies. Since being founded in 2015, the church’s mission to share truth through spiritual use of psychedelic medicines, have gained them a strong following within the state. 

The Birmingham Psychedelic Society of Alabama is another group whose focus is on providing educational resources on psychedelics and offering a platform to discuss the current climate of psychedelics in the state. In June of 2021, the University of Alabama in Birmingham received a grant approval to study the therapeutic benefits of psychedelics.
