The Legality of Psychedelic Therapy in Seattle

Washington has certainly been at the forefront of progressive drug policies, being one of the first states to legalize medical cannabis in 1998, closely followed by Oregon and Alaska.

While several initiatives related to drug reform have been proposed in Washington over the years, many have failed to pass, except for the significant success of Initiative 502 in 2012. 

This groundbreaking initiative made Washington the first state to legalize recreational cannabis use for adults aged 21 and older, garnering a 55.7% majority vote.

Under Initiative 502, adults can possess up to one ounce of cannabis, but cultivation, sale, and gifting remain illegal. The legislation also implemented regulations and taxation on cannabis production and sales while establishing new limits on THC levels for driving under the influence.

In recent years, discussions surrounding psychedelics have gained traction in Washington. In February 2021, the Seattle City Council passed a resolution that made the investigation, arrest, and prosecution of adults using psychedelic plants a low law enforcement priority.

Following in Oregon’s footsteps, Seattle decriminalized the possession of small amounts of drugs, including psychedelics, in October 2021. This measure also directed state funds toward the establishment of new treatment and rehabilitation programs rather than incarceration.

Similar initiatives have emerged in other cities across the state, indicating a shifting public opinion and recognition of the potential benefits of psychedelics. In December 2021, the City Council of Port Townsend unanimously voted to decriminalize naturally-occurring psychedelics. 

Washington State Governor Jay Inslee signed Senate Bill 5263, sponsored by Senators Jesse Salomon and Liz Lovelett, into law on May 9, 2023. This bill originally aimed to broaden access to psilocybin for therapeutic purposes. 

However, the bill underwent significant revisions during the legislative process. A psilocybin therapy pilot program, which will provide therapeutic access to psychedelics for mental health treatment, was established, commencing on January 1, 2025.

The program will take place at the University of Washington and serve military veterans and first responders seeking treatment for PTSD, substance use disorders, or other mental health conditions.

Because psilocybin is currently a Schedule I controlled substance, it should be noted that the pilot program is limited to pathways approved by the FDA, and addressing this discrepancy remains a challenge.

In addition to these developments, Governor Inslee signed an additional bill into law that protects workers from employment discrimination based on their lawful use of cannabis during the hiring process. 

Advocates believe that the passage of SB 5263 has the potential to pave the way for broader and more inclusive reforms in the future, especially from the outcomes of the pilot program.

These recent actions reflect a growing recognition of the failures of past drug policies, such as the “War on Drugs,” and the urgent need for a new approach centered on treatment rather than punishment.

The Difference Between a Psychedelic Therapist, Guide, & Facilitator

While psychedelic therapy may not be available in Seattle at the moment, it’s still possible for you to have a transformative psychedelic experience.
