Prop 122 also decriminalized the use, possession, cultivation, and sharing of these substances. While selling is prohibited, gifting these substances is allowed as long as there is no exchange of money or other items.

Reinforcing Prop 122, Senate Bill 23-290 went into effect this past July, establishing a regulatory framework for the legal use of natural medicine in licensed healing centers. More specifically, psilocybin healing centers will be among the first to operate under this framework.

So, what does this mean for the city of Loveland?

Unlike Measure 109 in the state of Oregon, Prop 122 doesn’t allow Colorado cities to opt out of opening psychedelic healing centers. The only say that the cities in Colorado have is determining where these centers can be located and their hours of operation.

It’s anticipated that the psychedelic healing centers will finish accepting applications by the end of 2024, which means you’ll start to see these establishments become available around the middle of 2025.
