Another milestone was reached a few years later when Denver became the first city to decriminalize psilocybin, or “magic mushrooms,” with a close vote of 50.64% to 49.36% in 2019.

More recently, Proposition 122 was approved in November 2022. Prop 122, also known as the Natural Medicine Health Act, decriminalized naturally occurring psychedelic substances, including psilocybin, psilocin, DMT, ibogaine, and mescaline (not from peyote).

Under Prop 122, personal possession, cultivation, sharing, and use of these natural psychedelics are decriminalized for adults aged 21 and older. It’s important to note that you’re allowed to gift these substances, but you are not allowed to sell them.

In addition, Prop 122 also paved the way for a legal psychedelic access program, allowing adults to consume psilocybin mushrooms within licensed facilities under the supervision of licensed healthcare professionals.

These healing facilities are set to become accessible by the end of 2024. In 2026, these facilities will extend their services to encompass other natural psychedelics included in Prop 122.

Continuing the forward momentum, Colorado achieved another milestone just last month with the passage of Senate Bill 23-290. This bill reinforces Prop 122 and refines the regulatory framework surrounding natural psychedelic substances and their lawful use.

As a result, law enforcement no longer prioritizes these substances, and criminal penalties related to natural psychedelics have been significantly reduced.

It’s important to remember that these new laws do not fully legalize naturally occurring psychedelics, and all psychedelics are still categorized as Schedule I drugs under federal law.
