It’s important to note that Prop 122 doesn’t permit exchanging psilocybin for other items, as this would be classified as selling. However, gifting these substances is allowed.
The naturally occurring psychedelics encompassed by Prop 122 include psilocybin, psilocin, DMT, ibogaine, and mescaline (excluding peyote).
Following this, SB 23-290 was passed on May 2, 2023, which implements and replaces Prop 122. The bill reaffirms Prop 122 while regulating access to natural psychedelics through licensed healing centers.
Overall, it aims to establish a simpler approach to using these substances for medical and personal use. The progressive bill was signed into law on May 23, 2023 and went into effect on July 1, 2023.
Most notably, SB 23-290 allows supervised use of psychedelic mushrooms in licensed facilities for the residents of Colorado. Although we’ll have to wait until the end of 2024 to see these licensed centers, it’s still a major advancement in the psychedelic world.
By 2026, other natural psychedelic substances, such as ibogaine and mescaline, will be permitted for use in these licensed facilities, and the bill will define regulations for the facilitators who oversee these experiences.
In addition, SB 23-290 established the Natural Medicine Advisory Board, which takes responsibility for matters related to natural psychedelics and provides recommendations concerning their use.
The passing of Prop 122 and SB 23-290 offer relief for those previously convicted of drug-related crimes pertaining to personal use and cultivation of psychedelics, as these individuals can now have their records sealed after carrying out their penalties.
Furthermore, SB 23-290 acknowledges the significance of indigenous cultures where these naturally occurring psychedelics originate. The bill protects these communities, their cultures, and traditions to prevent the commercialization of these sacred plants.
Overall, it’s important to keep in mind that while these psychedelics are decriminalized, they remain illegal under federal law, as they are classified as Schedule I substances. Decriminalization means that these substances are of the lowest priority of law enforcement.

As we already know, SB 23-290 permits the gifting of psychedelics, but let’s go into the specifics of what gifting really entails.
According to SB 23-290, sharing natural medicine for personal use is decriminalized as long as there is no remuneration, or payment, involved and provided that it’s not part of any business transaction.
Additionally, sharing natural medicine with bona fide harm reduction or support services is also decriminalized, where remuneration is exchanged for these genuine services.
